Terms & Conditions

Different By Design Coaching Effective: 2026

1. Introduction

These Terms & Conditions ("Agreement") outline the expectations, responsibilities, and boundaries between:

 

  • Coach: Kath Parker, Different By Design Coaching ("we", "us", "our")

  • Client: The individual engaging coaching services ("you", "your")


By booking or attending a session, you agree to these Terms & Conditions.

2. Nature of Coaching

Coaching is a forward focused, collaborative process designed to support clarity, confidence, performance, and personal development.

Coaching is not:

 

  • counselling

  • therapy

  • mental health treatment

  • crisis support


Coaching does not diagnose or treat mental health conditions. You remain responsible for your decisions, actions, and outcomes.

If you require therapeutic or clinical support, you agree to seek assistance from a qualified mental health professional.

3. Services Provided

 

We may provide:
 

  • ADHD informed life coaching

  • Strengths based planning and accountability

  • Values clarification

  • Strategy development and brainstorming

  • Identifying patterns, barriers, and next steps

  • Reflective questioning and supportive dialogue


Sessions may be delivered online, by phone, or in person.

4. Fees, Payment & Packages

 

  • Fees will be communicated clearly before engagement.

  • Payment is required before or on the day of each session unless otherwise agreed.

  • Packages (if purchased) must be used within the timeframe specified at purchase.

  • All prices include GST where applicable.


Refunds

Under Australian Consumer Law, refunds are provided only where services fail to meet consumer guarantees. Change of mind refunds are not offered.

5. Scheduling, Cancellations & Rescheduling

 

  • Sessions may be rescheduled with at least 24 hours’ notice.

  • Cancellations with less than 24 hours’ notice may be charged at the full session rate.

  • Repeated cancellations may result in termination of the coaching relationship.


6. Client Responsibilities

You agree to:

  • Attend sessions on time and prepared

  • Communicate honestly and openly

  • Take responsibility for your actions and outcomes

  • Seek appropriate professional support when needed

  • Disclose any relevant wellbeing or mental health history that may impact coaching


Refunds

Under Australian Consumer Law, refunds are provided only where services fail to meet consumer guarantees. Change of mind refunds are not offered.


7. Confidentiality

All information shared in coaching is confidential except where:

 

  • required by law (e.g., subpoena)

  • there is a risk of harm to yourself or others

  • there is disclosure of abuse involving a minor

  • you provide written consent for information to be shared


We adhere to the International Coaching Federation (ICF) Code of Ethics.

8. Privacy & Data Handling


Different By Design Coaching complies with the Privacy Act 1988 (Cth), the Australian Privacy Principles, and the 2026 privacy reforms.

9. Technology & Online Sessions

You are responsible for ensuring:

 

  • a stable internet connection

  • a private, distraction free environment

  • up to date software and equipment
     

We are not liable for disruptions caused by technology outside our control.

10. Intellectual Property

All materials, tools, worksheets, and resources provided by Different By Design Coaching remain our intellectual property.
You may not reproduce, share, or distribute these materials without written permission.

11. Limitation of Liability

To the extent permitted by Australian law:

 

  • We are not liable for decisions or actions you take during or after coaching.

  • Coaching outcomes cannot be guaranteed.

  • Liability is limited to the amount paid for services.


This clause is consistent with Australian Consumer Law.

12. Termination of Agreement

Either party may terminate the coaching relationship:

 

  • with written notice

  • if the relationship is no longer productive

  • if boundaries, safety, or ethical standards are compromised


Unused prepaid sessions will be refunded unless termination is due to repeated cancellations or misconduct.

13. Dispute Resolution

If a concern arises:

 

  • You agree to raise the issue directly with us.

  • Both parties will attempt to resolve the matter in good faith.

  • If unresolved, the matter may be referred to mediation under Australian law.


14. Acceptance

By booking or attending a session, you acknowledge that you have read, understood, and agree to these Terms & Conditions.
